These terms form a binding agreement between you and the operator of Sunder. Please read them in full. They include important limits on our responsibility to you, a section explaining that Sunder is not legal advice, a limit on the time you have to bring a claim, and an agreement about where disputes are heard. If you do not accept these terms, do not create an account and do not use Sunder.
By creating an account, signing in, or otherwise using Sunder, you confirm that you have read these terms, that you understand them, and that you agree to be bound by them. If you are using Sunder on behalf of someone else, you confirm that you have the authority to bind that person to these terms, and "you" means both of you.
In these terms, "Sunder", "we", "us" and "our" mean the Sunder service and the individual who operates it. These terms apply together with our Privacy Policy, which describes how we handle information.
Sunder is operated by an individual based in the Commonwealth of Virginia, United States. Written questions, notices, and requests under these terms should be sent to support@sunderweb.com, which is the address we monitor for this purpose, and which is the correct address for service of any formal notice.
You must be at least 18 years old and able to form a binding contract to create an account. Sunder is offered to people in the United States and is written around United States immigration. It is not directed to any other country, and we make no claim that it is suitable for, or lawful under, the laws of any other jurisdiction. If you use Sunder from outside the United States, you do so on your own initiative and you are responsible for compliance with your own local law.
You may not use Sunder if you are barred from doing so under applicable law, including trade sanctions and export-control rules, or if we have previously closed your account.
One person, one account. You may not share your account or let anyone else use it.
THIS IS THE MOST IMPORTANT SECTION OF THESE TERMS. Sunder provides general information to support your own immigration planning. It is not a law firm, does not provide legal advice, and does not create an attorney-client relationship between you and anyone. No part of Sunder is a substitute for advice from a licensed immigration attorney who knows the facts of your case.
Nothing Sunder shows you is legal advice, a legal opinion, a determination of your immigration eligibility, a recommendation to take or avoid any particular step, or a prediction of what any government agency will decide or when. Sunder does not prepare, select, complete, review, sign, or file forms on your behalf, and does not represent you before any government agency or court.
Immigration law is complex, fact-specific, and changes frequently. Deadlines and consequences in this area can be severe and are often irreversible. Before you file anything, sign anything, travel, change or leave a job, allow a date to pass, or take or refrain from any step that could affect your status, you must obtain advice from a licensed immigration attorney. Do not rely on Sunder for any of these decisions.
You are solely responsible for verifying any information you see in Sunder against official government sources and with your own attorney before acting on it.
Using Sunder does not make us your attorney, your accredited representative, your agent, or your adviser, and does not make you our client. No confidential or privileged relationship arises from your use of Sunder, and information you enter is not protected by attorney-client privilege.
Sunder is an independent product. It is not affiliated with, endorsed by, sponsored by, or connected to the United States government or any of its departments or agencies. Government names, form numbers, and terms of art are used only to describe publicly available information.
Sunder uses artificial intelligence to help organize information, generate wording, and answer questions in chat. Artificial intelligence systems can produce output that is inaccurate, incomplete, outdated, internally inconsistent, or wrong in ways that are not obvious. Output may be stated confidently and still be mistaken.
You must treat anything produced with artificial intelligence as information to be checked, never as an answer to be relied upon. We do not warrant the accuracy, completeness, currency, or suitability of any generated output, and the disclaimers and limits of liability in these terms apply fully to it.
Sunder draws on public sources and on information you provide. Public sources change, and our coverage of the immigration landscape is partial and uneven by design. A route, requirement, date, fee, or rule shown in Sunder may be incomplete, superseded, or not applicable to your situation, and the absence of something from Sunder does not mean it does not exist or does not apply to you.
We do not undertake to keep any particular information current, to notify you of legal changes, or to monitor your case, your deadlines, or your status on your behalf. Monitoring your own dates and obligations remains your responsibility at all times.
Immigration outcomes depend on many factors outside our control, including agency discretion, processing volumes, policy changes, and facts we never see. Sunder cannot promise any particular decision, timeline, or result. Nothing in the product, in our communications, or in any generated wording constitutes a promise, warranty, or prediction about what will happen in your case.
You use Sunder voluntarily and at your own risk. You are responsible for the decisions you make, for the accuracy and completeness of what you enter, for obtaining independent professional advice, and for the consequences of acting or failing to act.
To the fullest extent permitted by law, you assume all risk arising from your use of Sunder, including any risk that information is inaccurate, incomplete, outdated, or unsuitable for your situation, and any risk arising from a step you take or do not take in reliance on it.
You are responsible for keeping your sign-in credentials confidential, for the accuracy of the information on your account, and for all activity that occurs under it. Notify us promptly at the address above if you believe your account has been accessed without your permission. We are not responsible for loss arising from your failure to keep your credentials secure.
You agree not to: use Sunder for any unlawful purpose, or in a way that infringes anyone's rights; enter another person's information without a lawful basis and their permission; impersonate any person or misrepresent your affiliation; present Sunder's output to anyone as legal advice, or use it to provide immigration assistance to others for a fee; upload malicious code, or anything you do not have the right to upload; probe, scan, disrupt, overload, or attempt to gain unauthorized access to the service or its systems; circumvent any access control, rate limit, or security feature; scrape, harvest, copy, resell, sublicense, or commercially exploit the service or its content; use the service to train, fine-tune, or benchmark any machine-learning model; or reverse engineer any part of the service except where that restriction is prohibited by law.
We may investigate suspected breaches and may suspend or close accounts involved, without notice where the circumstances make notice inappropriate.
You keep ownership of the information and documents you add to Sunder. You grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, transmit, display, and process that content solely to operate and provide the service to you, and to comply with law. This licence ends when the content is deleted, except for copies retained in routine backups until they are overwritten, and except where we must keep something by law.
You represent that you have the right to provide the content you add, including any information about other people, and that doing so does not breach anyone's rights or any obligation you owe.
If you send us suggestions, ideas, or feedback about Sunder, you agree that we may use them without restriction, without obligation to you, and without compensation, and that we may do so for any purpose including improving or commercializing the service.
Sunder, including its software, design, text, structure, compilations of information, and branding, is owned by us or our licensors and is protected by intellectual property law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the service for your own immigration planning, subject to these terms. All rights not expressly granted are reserved. You may not use our name or branding without our written permission.
Sunder relies on third-party providers and may reference or link to third-party resources, including government websites. We do not control those services or resources, do not endorse them, and are not responsible for their content, availability, accuracy, or practices. Your use of a third-party service is governed by that provider's own terms.
Sunder is offered as an early-stage product. It may contain errors, may be interrupted, and may change substantially or be withdrawn. Features described anywhere may be incomplete, may behave differently than described, or may not be available to you. You should not make any decision, commitment, or plan in reliance on the continued availability of the service or of any feature.
We may add, change, suspend, limit, or withdraw any part of Sunder at any time, with or without notice, and we may impose limits on use or storage. We do not promise that the service will be available at any particular time or at all. If we discontinue the service generally, we will make reasonable efforts to give you an opportunity to retrieve your information first.
You may stop using Sunder at any time and delete your account in Settings. We may suspend or close your account, or restrict access, if we reasonably believe these terms have been breached, if required by law, if necessary to protect the service or other users, or if we cease offering the service. On closure, your licence to use the service ends immediately.
TO THE FULLEST EXTENT PERMITTED BY LAW, SUNDER IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICE OR ITS CONTENT IS ACCURATE, COMPLETE, RELIABLE, CURRENT, OR SUITABLE FOR YOUR SITUATION; OR THAT THE SERVICE WILL MEET YOUR REQUIREMENTS.
NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM US OR THROUGH THE SERVICE, CREATES ANY WARRANTY NOT EXPRESSLY STATED HERE. Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OPPORTUNITY, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO SUNDER, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, STATUTE, OR ANY OTHER THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE ABOVE, WE WILL NOT BE LIABLE FOR ANY IMMIGRATION CONSEQUENCE, INCLUDING ANY DENIAL, DELAY, LOSS OF STATUS, MISSED DEADLINE OR FILING WINDOW, ACCRUAL OF UNLAWFUL PRESENCE, REMOVAL, BAR ON RE-ENTRY, LOSS OF WORK AUTHORIZATION, OR ANY COST, PENALTY, OR FEE, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICE OR FROM ANY ACTION YOU TOOK OR DID NOT TAKE.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO SUNDER WILL NOT EXCEED THE GREATER OF ONE HUNDRED UNITED STATES DOLLARS OR THE TOTAL AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limits apply even if a limited remedy is found to have failed of its essential purpose. Some states do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you, and nothing in these terms excludes liability that cannot be excluded by law, including for fraud.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless the operator of Sunder, and anyone working with us, from and against any claims, demands, proceedings, losses, damages, penalties, and reasonable legal costs arising out of or relating to: your use of the service; information you entered, including information about any other person; your breach of these terms or of any law; or your infringement of anyone's rights. We may assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with us.
To the fullest extent permitted by law, any claim relating to Sunder must be filed within one year after the claim arose. A claim filed after that period is permanently barred.
Come to us first. Before starting any formal proceeding, you agree to write to support@sunderweb.com describing the problem, what you would like done, and the relevant facts, and to allow sixty days for us to resolve it in good faith. This step is a condition of bringing a claim, and the one-year period above is paused while it runs.
If the matter is not resolved, these terms and any dispute arising out of or relating to them or to Sunder are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-laws rules, and the state and federal courts located in that Commonwealth have exclusive jurisdiction. You and we each consent to that jurisdiction and waive any objection to venue or forum. Nothing here prevents you from bringing an individual claim in your local small-claims court, or either of us from seeking injunctive relief where appropriate.
TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND WE EACH WAIVE ANY RIGHT TO A TRIAL BY JURY, AND EACH AGREE TO BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. If this waiver is held unenforceable as to a particular claim, that claim alone is severed and may proceed in court, and the remainder of this section continues to apply.
We are not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disaster, war, terrorism, civil unrest, epidemic, labor dispute, power or network failure, failure of a third-party provider, government action, or change in law.
We may update these terms from time to time. The date shown at the top of this page is the date they last changed, and you should review it periodically. If you continue to use Sunder after a change takes effect, you accept the updated terms. If you do not accept them, your remedy is to stop using Sunder and delete your account.
If any provision of these terms is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary, the intent of the provision will be given effect as far as the law allows, and the remaining provisions will continue in full force. Our failure to enforce a provision is not a waiver of it, and a waiver on one occasion is not a waiver on any other.
You may not assign or transfer these terms or any rights under them without our written consent. We may assign them, including to a successor in connection with a merger, acquisition, or sale of assets. These terms bind and benefit each party's permitted successors.
Nothing in these terms creates a partnership, joint venture, employment, franchise, or agency relationship, and there are no third-party beneficiaries.
Notices to you may be given by email to the address on your account or by posting in the service; notices to us must be sent to the address in section 2. These terms, with our Privacy Policy, are the entire agreement between you and us about Sunder and supersede any earlier understanding.
The sections concerning legal advice, no relationship, your responsibility and assumption of risk, your content, feedback, our intellectual property, disclaimer of warranties, limitation of liability, indemnification, time limit for claims, resolving disputes, and this section survive any termination of these terms or closure of your account.
